Terms and Conditions

1. Acceptance of These Terms; Changes to Them

This document forms a legal agreement between you and VehHistory setting out the rules that govern how you may use our services (“Services”), which we make available through our website, https://vehhistory.com. Using the website or the services in any way constitutes your acceptance of being bound by these Terms.

From time to time and at our discretion we may revise these Terms, and such revisions may bring in future terms, licenses, and other policies or procedures. Should that happen, we will inform you by email and by placing a conspicuous notice on the website. If you do not accept such changes, do not use our services. Continued use of vehhistory.com after changes have been posted signals your agreement to the modified Terms.

We retain the right to deny access to any service with or without a reason, including for failure to comply with these Terms.

2. Waiver of Class Actions, Required Arbitration, Dispute Resolution, and Governing Law

By using this Site, you acknowledge and agree that the mandatory arbitration provision below binds you; as a general matter it requires disputes to be settled by individual arbitration instead of through court proceedings or class actions. That provision also restricts the remedies available to you should a dispute arise.

You agree that every claim, dispute, or controversy between you and VehHistory, including its employees, agents, affiliates, subsidiaries, predecessors, successors, or assigns, arising out of or relating to the Site, any related websites, content, data, services, materials, transactions, relationships, or your information, including but not limited to claims in tort and in contract and claims brought under any federal, state, or local statute, law, order, ordinance, or regulation, shall be settled exclusively by final and binding arbitration as provided herein.

Any such claim may be brought only in your individual capacity and not as a plaintiff or class member in any purported class, representative, or private attorney general proceeding.

You acknowledge and agree that whether a dispute falls within the scope of arbitration is for the arbitrator to determine rather than a court, and that the arbitrator may neither consolidate the claims of more than one person nor preside over any form of class or representative proceeding. In agreeing to this arbitration provision, you knowingly and voluntarily give up any right you might have to have such a dispute heard by a court.

Class Action Waiver: You additionally waive expressly any right to bring or take part in any class action connected with or arising from these Terms or the subjects they cover. This waiver is material and essential to the arbitration agreement and is non-severable from it.

If you do not accept this arbitration agreement and class action waiver, you must tell us in writing and stop using the Site and any related services immediately.

Governing Law: These Terms are governed by and shall be construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws principles. Any dispute arising hereunder shall be treated as having been executed and performed in Hong Kong.

Dispute Resolution Process: Before starting arbitration or litigation, you agree to try to settle any dispute informally by sending written notice that describes your claim and your proposed resolution to VehHistory’s customer service at support@vehhistory.com or by certified mail to:

VehHistory will reply within a reasonable time, and both parties will negotiate in good faith for at least 30 days in an effort to resolve the dispute informally. If the dispute remains unresolved after 30 days, it must be referred to binding individual arbitration seated in Hong Kong and administered by a reputable arbitration organization that both parties agree upon, under rules applicable to consumer-business disputes. If the parties reach no agreement on the arbitration provider, either of them may petition a court to appoint a neutral arbitrator.

Exceptions: Claims concerning intellectual property rights or unauthorized access to data may be filed in the courts of the Hong Kong Special Administrative Region. For these claims, both parties consent to the jurisdiction and venue of such courts.

Arbitration Procedure: Arbitration may take place remotely via an online platform so that travel is unnecessary. Arbitration fees will be confined to the filing fees prescribed by the arbitration organization’s rules. Any arbitration award may be entered as a judgment in any court with jurisdiction.

Should the arbitrator rule in your favor, VehHistory agrees to reimburse your reasonable attorneys’ fees and costs. Should the ruling favor VehHistory, you bear your own fees and costs.

3. Age Eligibility for Using the Service

VehHistory’s services are meant solely for individuals who are at least eighteen (18) years old and who have reached the age of legal majority in the jurisdiction where they reside, if that age is older than 18. By using the services, you represent and warrant that you meet these eligibility requirements and hold the legal capacity to enter into a binding agreement with VehHistory. Anyone who does not meet these requirements may not use or access VehHistory’s services.

4. Required Software and Hardware

Using VehHistory’s services requires Internet access along with certain software that you may be responsible to pay for. Occasional upgrades and updates are also likely to be needed. We suggest high-speed Internet for reaching our site, since performance may be hindered otherwise. We do not warrant that your computer or device will be compatible with the Services. We shall not be responsible for your failure to access the site or our Services, and no refunds shall be granted in such an event.

5. What You Can and Cannot Expect from VehHistory

a. Service Quality and Delivery

Although we strive to keep service running without interruption, we cannot guarantee that you will never encounter disruptions, omissions, inaccuracies, or delays. Since you may reach VehHistory’s services over a cellular system, Internet lines, or a public switched telephone network, power outages or other interruptions beyond our control may occur.

b. Technical Upgrades and Maintenance

At any time we may alter our Service offerings so as to stay compliant with regulations and to keep what we offer up-to-date. Repairs or updates to our system may require us to limit or even suspend services.

c. Communication Content

We are unable to control any content distributed through the use of our Services. Responsibility for content rests solely with the entity that originates it. For that reason, content you come across may possibly be offensive, illegal, or otherwise questionable, or it may be inaccurate, untimely, or erroneous.

d. General Use and Storage Practices

We accept no liability for any content that we hold. We likewise accept no responsibility for information that is deleted from or transmitted out of the system. We have the right to limit use of our Services at any time.

e. Service Content

At any time we may remove or decline to distribute any content that appears via our Services. Doing so may result in errors and inaccuracies in reports or in the untimeliness of the same. VehHistory is not responsible for any third-party content and may access and/or disclose information it believes needed to:

• satisfy any legal requirements;
• uphold these terms of service;
• guard against cyber threats and technical problems;
• respond to user concerns;
• safeguard the integrity of VehHistory, its users, and the public.

f. Suspending or Ending Access for Cause

Without prior notice, VehHistory may suspend, restrict, or terminate your access to the Services, whether wholly or in part, if VehHistory determines or reasonably suspects that you have breached these Terms, made excessive or abnormal use inconsistent with personal consumer use, used the Services for resale or other unauthorized commercial purposes, shared account access, attempted to get around subscription or usage limits or controls, or behaved in a fraudulent, abusive, unlawful, or otherwise harmful manner. VehHistory may take such action immediately and without liability to you. Where access is suspended or terminated for cause, VehHistory will have no obligation to provide any refund, credit, or other compensation, to the fullest extent permitted by applicable law.

6. Registering an Account and Your Responsibilities

Using the Services requires you to create and maintain a VehHistory account. You agree to supply accurate, current, and complete information when registering and to keep your account information up to date.

a. One Account Per User; No Transfers.
Except where VehHistory expressly authorizes otherwise in writing, each account belongs personally to the registered user and may not be sold, transferred, assigned, shared, or otherwise made available to anyone else. You may not open multiple accounts to evade usage limits, subscription restrictions, enforcement actions, or other controls applicable to your account or plan.

b. Account Security and Responsibility.
Keeping your login credentials confidential is your responsibility, as is all activity that takes place under your account, whether or not you authorized it. You must notify VehHistory without delay of any unauthorized access to or use of your account, or of any other suspected security breach.

c. Eligibility and Account Restrictions.
VehHistory may decline a registration, halt account creation, limit access to the Services, or restrict, suspend, or terminate an account where doing so is reasonably necessary to protect VehHistory, its users, payment partners, service providers, or third parties, including in situations involving suspected fraud, abuse, misuse of promotions, attempts to bypass plan limitations, legal or regulatory risk, or breaches of these Terms. Without limiting the foregoing, you may not use the Services if you are located in, ordinarily resident in, or subject to restrictions under any jurisdiction or sanctions program that would render your use of the Services unlawful or expose VehHistory to legal, regulatory, or compliance risk. VehHistory may likewise restrict or terminate access where VehHistory determines or reasonably suspects that an account is connected with a sanctioned or blocked person, prohibited party, denied party, embargoed jurisdiction, or any other person or entity with whom VehHistory is not legally permitted to do business.

d. Suspension or Termination for Cause.
With no prior notice, VehHistory may suspend, restrict, or terminate your account or your access to the Services, whether wholly or in part, if VehHistory determines or reasonably suspects that you have breached these Terms, made excessive or abnormal use inconsistent with personal consumer use, used the Services for resale or other unauthorized commercial purposes, shared account access, attempted to get around subscription or usage limits or controls, or behaved in a fraudulent, abusive, unlawful, or otherwise harmful manner. VehHistory may take such action immediately and without liability to you. Where an account is suspended or terminated for cause, VehHistory will have no obligation to provide any refund, credit, or other compensation, to the fullest extent permitted by applicable law.

е. User Responsibility; No Reliance on Reports.
You acknowledge and agree that the Services, including any vehicle history report, search result, score, alert, or other information made available through VehHistory, are furnished for general informational purposes only. VehHistory gives no guarantee that any report or other information is complete, accurate, current, error-free, or suitable for your particular purpose. Assessing any information you receive through the Services is your responsibility alone, as is any decision or action you take on the basis of that information, including any decision to purchase, sell, inspect, finance, insure, or otherwise transact with respect to a vehicle. You agree that in making such decisions you are not relying solely on VehHistory’s Services or on any report provided through the Services, and that you should exercise independent judgment and, where appropriate, obtain additional information or inspections from qualified professionals before acting. To the fullest extent permitted by applicable law, VehHistory disclaims liability for decisions made or actions taken by you or by any third party in reliance on the Services or on any report, search result, or other information provided through the Services.

7. Rights We Reserve

VehHistory grants access to the Site as it happens to be available from time to time, subject to these Terms. Your use of the Site and any information obtained through it is your responsibility alone. VehHistory expressly reserves the right to:

• monitor, review, record, audit, or otherwise supervise your use or others’ use of the Site, our data services, and any information supplied by users during registration or the application process (“Registration Data”);
• moderate and settle any disputes arising between you and other users, visitors, or subscribers of the Site;
• verify the identity of anyone accessing or using the Site, prospective subscribers included, and likewise verify the purposes for which the Site is being used;
• decline, cancel, or terminate any orders or accounts that VehHistory, at its sole discretion, reasonably suspects to be fraudulent, to involve fraudulent activity, or to violate these Terms;
• watch subscriber and user activity for potential misuse or improper purposes, and to audit, investigate, require renewed confirmation of compliance, restrict, limit, suspend, or deactivate accounts as deemed necessary to ensure compliance with these Terms and applicable laws.

Opening multiple accounts in order to abuse free trials or promotions is prohibited and may lead to suspension or termination of your account.

8. Fees, Taxes, Billing, and Subscriptions

Using VehHistory’s services or buying products via the Site requires you to create an account and agree to pay applicable fees. All applicable fees, taxes, and billing arrangements, which may include recurring charges, will be shown to you before your purchase. By placing an order, you authorize VehHistory to charge the payment method you selected accordingly.

We may alter pricing, billing methods, or subscription terms at any time upon notice. If you do not agree, you may cancel your subscription before such changes come into effect. Subscription fees are non-refundable, except as required by law. VehHistory does not accept payment by check, cash, or money order.

All fees are subject to the applicable taxes determined by your place of residence. Should your payment method be compromised or should you suspect fraud, contact support@vehhistory.com immediately.

VehHistory Unlimited Vehicle History Subscription

a. No Authentication.

Reports draw on information from a vehicle’s previous sales records, price analytics, and odometer readings recorded when it was sold through auctions and classified websites. VehHistory is not liable for any damages resulting from the use or non-use of this information. Any VehHistory vehicle history report is used at your own risk.

b. No Guarantee.

The information contained in our reports carries no guarantee and may not be accurate, timely, or complete. We give no guarantee as to the condition of any vehicle.

c. Monitoring and Usage Restrictions.

Your subscription gives you unlimited access to generate vehicle history reports with no daily or monthly limits. To preserve the integrity and quality of our services, VehHistory monitors subscription usage patterns continuously. If we reasonably conclude that your usage points to commercial or business purposes, which a personal subscription does not permit, we reserve the right to restrict or limit your access temporarily. If such a restriction is applied, you will be told immediately by an automatic message displayed when you log in to the Site. To lift the restriction and regain full access, you must contact our Customer Support team. VehHistory will review your case and may offer options suitable for commercial use.

d. Scope of Order.

We are under no obligation to supply information beyond what our services expressly describe.

e. Subscription Fees.

Subscription fees are not fixed and can differ according to the subscription plan, promotional offer, sales channel, billing terms, currency, geographic region, and other factors. The exact subscription fee, the billing interval, and any applicable taxes or other charges will be clearly shown to you before you submit your order. By completing your purchase, you agree to pay the amount and on the billing terms disclosed at the time of purchase. All account and subscription terms herein apply to the specific subscription or plan you purchase.

f. Renewals.

Subscriptions renew automatically unless the user cancels them or VehHistory terminates them in accordance with these Terms.

g. Cancellation.

A user can cancel the subscription on their own from within the personal account. To cancel the subscription, a user needs to follow the detailed instructions below:

1. Sign in to your account on vehhistory.com with the method you used to register (email or Google).
2. Click the account number in the upper right corner to open the menu.
3. Choose “Subscriptions” and then click “Cancel subscription.”
4. Follow the prompts on screen to confirm the cancellation.

Make sure a confirmation message appears stating that the subscription has been canceled. If none is visible, take a screenshot and email it to support@vehhistory.com. Sending an email or call does not constitute an official cancellation—only self-service cancellation via the account is valid.

h. Price Changes.

VehHistory may adjust subscription prices upon prior notice. Continued use after such changes constitutes acceptance. You may cancel before the changes take effect so as to avoid charges at the new rate.

i. Trial Subscription.

We provide a trial subscription for new users who have never taken a trial on our website before. The trial subscription is open to new customers only and is limited to one per customer. The trial period runs for 3 days from activation. Users must cancel the trial subscription before the end of the 3-day period if they do not want it to convert automatically to a monthly subscription. Unless it is canceled within the trial period, it will automatically convert into a monthly subscription at the standard rate of $99.99 per month (or as communicated at time of trial initiation). All reports generated during the trial period are subject to the same terms as standard subscriptions.

j. Use of Reports.

Every report generated under any subscription is subject to these Terms and is intended for personal use only.

9. Billing Errors, Retried Payments, Authorization

You expressly authorize VehHistory to attempt to process recurring subscription charges against the payment method you selected.

Where a payment attempt is declined, fails, or is otherwise left incomplete, we may, at our discretion, make one or more further attempts to process the payment.

So that access to the Service continues without disruption, we may apply temporary promotional pricing, coupons, or reduced charges (including but not limited to partial discounts) during such retry attempts. 

You agree that these adjusted charges may be processed without further notice, provided they do not exceed the standard subscription fee. If we choose to apply such temporary promotional pricing or discounts and a retry attempt succeeds, that payment will satisfy your monthly payment obligation for that particular month.

Such adjusted charges count as part of the billing process and do not modify the original subscription terms or pricing.

You acknowledge and agree that paying any fees, charges, and expenses imposed by your bank, credit card issuer, or another third party because of rejected payment attempts is your exclusive responsibility.

If you think an error has occurred in your billing, please tell our Customer Support team as soon as possible by writing to support@vehhistory.com. We are committed to investigating and resolving any billing issues promptly to ensure your satisfaction.

10. Intellectual Property Rights

VehHistory Rights, which comprise the services that we offer and to which we own all right, title, and interest, are protected by U.S. and international intellectual property laws. As a user of our services, you agree not to copy, modify, or build derivative works based off our offerings. You will also not use any automated or manual process to copy or monitor our content.

You may not use our service marks, logos, trademarks, trade names, or any other brand features without written permission from us. Third-party content appearing in our services falls outside VehHistory Rights. Conversely, we are not responsible for any content that you post to our website directly or via a third party. As such, protecting your intellectual property is up to you.

By posting content on our services you signal your intent to allow VehHistory a worldwide, non-exclusive, royalty-free license to use such content as we deem appropriate. Whether content posted via our services remains posted is at our discretion. Information that you self-report, personal or otherwise, is authorized for us to use as outlined in our Privacy Policy. We may also share this information with third parties and call centers for their use. Submitting this information additionally authorizes us, third parties, and call centers to use your phone number to contact you. Do not submit your information if you do not wish to be contacted via telephone.

11. General Compliance with the Law

VehHistory runs its services from offices located in the United States. By using our services you affirm that you comply with all applicable laws, statutes, ordinances, and regulations.

12. How We Enforce These Terms

We may employ whatever means we feel necessary to give effect to all terms of service in this agreement. This includes VehHistory’s need to comply with all related legal processes. Your use of VehHistory’s services means you grant us the right to disclose any volunteered information to law enforcement authorities, municipal entities, or others reasonably necessary for compliance purposes without liability to you.

13. Third-Party Materials or Websites Are Not Our Responsibility

VehHistory is not responsible for third-party content that appears on vehhistory.com or for third-party websites that we link to. We make no representations regarding the accuracy, timeliness, or completeness of any report. We will furthermore have no liability or responsibility for third-party collected data or for the accuracy, timeliness, or completeness of any report. This covers information related to the condition, safety, marketability, merchantability, quality, ownership history, and accident history of any passenger motor vehicle or data contained in or omitted from a passenger motor vehicle ownership or registration document any state issues in the U.S. or any Canadian province. We are not responsible for your use of any third-party materials or any purchase decisions made in reliance on the same.

14. Warranty Disclaimer; Limits on Liability

a. You acknowledge that we may occasionally discontinue our services and that we may cancel the services at any time without notifying you.

b. In no way do we give warranties of any kind, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Services are supplied “as is” and “as available.” The exclusion of implied warranties may not be allowed in your jurisdiction.

c. Neither VehHistory nor its affiliates may be held liable for indirect, special, consequential, or punitive damages of any kind, including loss of use, data, or profits, whether in an action in contract, tort, or that arises out of or in any way connected with:

• an inability to use vehhistory.com, its content, or services;
• content that is inaccurate, or delays;
• obtaining substitute goods or services;
• unauthorized access;
• the conduct of third parties;
• events of force majeure;
• any other matter relating to vehhistory.com.

Where liabilities could have otherwise been limited, our aggregate liability shall not exceed $100. Ceasing to use vehhistory.com is your sole means of remedying any dissatisfaction with the site and/or related services.

d. We accept no responsibility for any injury or damage that may arise from reliance on a VehHistory report.

15. Indemnification

By using our services you affirm that you will indemnify, defend, and hold harmless VehHistory and its affiliates with respect to any claim that may arise out of or relate to your breach of this agreement, your use of our services and any report, or any action that VehHistory may take due to investigations of potential or actual agreement violations.

16. Notices

Notices regarding our services take effect immediately and may be delivered to you via the email address you have entered in your account contact information. As an alternative, we may send you a letter via postal mail to the address that you have entered in your account contact information.

17. Governing Law and Venue

Any questions concerning the validity, construction, and interpretation of these Terms of Service shall be governed by the law of the Hong Kong Special Administrative Region. Suits, actions, or proceedings related to these Terms of Service shall be brought in the courts of the Hong Kong Special Administrative Region. To the fullest extent that the law allows, the parties irrevocably waive any objection they may have to the agreed upon venue in any such suit, action, or proceeding. The final judgment resulting from any such suit, action, or proceeding that is brought in any such court shall be binding and enforceable in any court that the party is subject to jurisdiction by suit upon such judgment.

18. Miscellaneous

If any portion of these Terms of Service is found invalid or unenforceable, that will not negate the remaining portions, which will still be in full force and effect. These Terms of Service serve as our agreement with you and govern your use of our services, to the exclusion of any previous agreements between you and us. Our failure to enforce a provision or right contained within the Terms of Service does not negate that provision or right, or any other aspect of these Terms of Service.

Keep in mind that accessing affiliate services, third-party content, or third-party software may subject you to the terms and conditions of others. We will not be responsible for an inability to fulfill any obligations because of conditions not within our control.
